These provisions regulate the use of the Internet Web Site service AVALEX.ES (herein after the ‘Portal’) that the solicitors/lawyers Mª Ángeles Martín Conejo (Colegiada nº 6444) and Mª Victoria Sánchez García (Colegiada nº 7544) makes available to Internet users, being each and every provision of this Legal Notice governed by Spanish law.
The solicitors/lawyers Mª Ángeles Martín Conejo, with Spanish ID nº 74.846.440-R (Colegiada nº 6444 of the Bar Association of Málaga) and Mª Victoria Sánchez García with Spanish ID nº 25.683.526-R (Colegiada nº 7544 of the Bar Association of Málaga) have their bussiness office at Calle del Mar, nº 32, 1 º B, 29740 Torre del Mar (Vélez Málaga-Spain); however they act independently in the professional practice of law, reason why their professional responsibility is in tis way equally independent. For this reason, all references to the responsibility assumed through this Portal are made directly to both solicitors/lawyers, Mª Ángeles Martín Conejo and Mª Victoria Sánchez García, so that from now on the reference will be made to “the lawyers”.
Your use of the Web makes you a user of it (“User”) and implies your acceptance of all the conditions included in this Legal Notice. The web site service is provided for a duration that is limited to the moment when User is connected to the web site or to any of the services provided through the web. User must therefore read this Legal Notice carefully each time User intends to use the web site, since the web site and the conditions for its use as set forth in this Legal Notice may change.
Certain web site services accessible to Internet users or exclusive to the lawyers clients may be subject to particular conditions, regulations or instructions that, if appropriate, may supersede, supplement and/or amend this Legal Notice and must be accepted by User before the provision of the relevant service begins.
All the information provided by the User through the web site o by any other ways must be truthful. For these purposes, the User guarantees the authenticity of all the data communicated and will keep the information provided to the lawyers through this web site perfectly updated so that it responds, at all times, to the real situation of the User. In any case, the User will be solely responsible for the false or inaccurate statements made and for the damages caused to the lawyers or third parties for the information provided.
Since the Content of the web site is of a general nature and does not in any way constitute the provision of a tax or legal advisory service of any kind, such information is insufficient for User to make personal or business decisions.
The lawyers are not liable for decisions made on the basis of the information supplied on the web site, or for any damage or loss to User or to third parties by reason of actions taken that were solely based on information obtained on the web site.
Access to the Portal does not imply any obligation on the lawyers to control the absence of viruses, worms or any other malicious software. User is responsible in all cases for having available adequate tools for detecting and disinfecting malicious software.
The lawyers are not liable for any damage to the hardware of Users or of third parties during the provision of the web site.
Access to the web site requires services and supplies from third parties, including transmission through telecommunications
Pursuant to the provisions of Personal Data Protection Organic Act 3/2018, 5th December (hereinafter ‘LOPD’), we inform you that any personal data and information you provide us on completing any electronic form available on the web site (‘Data’) shall be included on a personal data filing system controlled by the lawyers. The purpose of the Data processing is to process your request. The lawyers reserve the right not to process applications when the user has been requested to provide with more information.
The lawyers adopt the security measures required by Royal Decree 1720/2007, of December 21, 2007, approving the regulations implementing the LOPD, in line with the nature of the data processed from time to time. Notwithstanding the foregoing, the technical security of a medium such as the Internet is not impregnable and there may be wilful misconduct on the part of third parties, although the lawyers have set in place all of the measures within their power to prevent such misconduct.
The lawyers shall only use data storage and recovery devices (‘Cookies’) where the user has granted its prior consent in such connection in line with indications in the pop-up on the users web browser when accessing the web site for the first time and on the other terms and conditions set forth in the lawyers Cookies Policy, of which all users should be aware.
The User may exercise its rights of Access, Rectification, Cancelation and Objection (‘ARCO Rights’) on the terms legally provided for such purpose sending a communication by post to the business office of the lawyers in la Calle del Mar, nº 32, 1º B 29740 Torre del Mar (Vélez Málaga-Spain) or sending an e-mail to the following addresses: info@avalex.es, amc@avalex.es and victoria@avalex.es, indicating name and surnames.
